Housing rights is a basic human right. In the past decade, there are many housing problems in china, seriously affected the economic development, social stability and human rights protection. So our state must assume the respect, protection, promotion and implement obligations of housing support, from improving the housing security legislation, put strict supervise over housing policy and implement housing rights obligations. This paper research international housing rights theory, combined with constitutional and political science principles, base on our own and face to other country to explore the most advanced housing security system in the world, and use value analysis, comparative analysis and empirical analysis For our own housing rights security system. This paper contains six parts:Introduction part account writing background, lead to the necessity of national housing rights obligations.The first part discusses the basic theory of the housing right. From a historical point of view to examine the formation of housing right, and than define the housing rights concept and discussed it’s nature, content and subject, using them to pave the way for the next part.The second part begin with the benefits of countries fulfill the obligations, discusses the national protection obligation of housing rights. By analyzing the international housing human rights legal documents, refined the basic principles and content of the state obligations of housing rights.The third part investigated the practical experience of major national and regional of housing security, Provide a reference for construct china’s housing rights system.The fourth part analysis the housing security status, problems and causes in china.The final part rebuilds the system of housing rights from legislation, policies, supervision, and relief. Provide specific measures and recommendations to fulfill t he national protection obligation of housing rights.
