Public Participation Procedure In China’s Transformation Of The Old

Based on the attemptation to analyze the interests of the involved in transformation of theold,,this article will analyze the interests of stackholders and practical experience mode inour country. On summarizing the barriers to public participation in the practice andinstitutional development, this passage will give a public participation design in China’stransformation of the old program.The thesis is divided into five parts:The first part is about the defintions of the basic concepts. In this article, writer describesacademic definitions of the concept of public participation, and defines public participation isas produres in the transformation of the old.In this part,according to its content, thetransformation of the old is summed up to three ways:the development,repairing theprotection.Using Stackholder analysis as the method,writer analyzes the interests of therelated in the practice.The second part is discussing about the modes of operation in transformation of the old,aswell as the participation in the different modes of operation, including the interests andinfluence of the people within.In accordance with different dominat figure,the modes ofoperation can be divided into three modes:government-led mode,developers investingmode,government assistance-residents antonomy mode.On discussing different provisions foreach mode of transformation of the old,this section will discribe influence and needs of theinvolved with stackholder anaylsis.The third part is discussing typical cases in different modes on the base of the content oflast section.Althouth China has no uniform detailed provisions about public participationprocess in the transformation of the old,there has been a few attemptations we can learn from.The forth part describes the lack of public particaipation procedures in China’stransformation of the old.Based on the last two parts and some provisions before,this sectiondraws on some rearchs of previous studies,then analyzes how residents’ level of educationimpacts participation procedures.There are three types of problems in the public parcipation procedure in the transformationof the old.First, due to the definitions are not clearly and stakeholder analysis is unknown,theinvolved roles are dislocation on the value level. Second, there is no detailed description of procedures for public participation on the institutional level, and the provisions of its lawlegal effect is unclearly.What’s more,, the residents’ low-income and low levels of educationaffect the effect of public participation.The last part is about the development of public participation in China’s transformation ofthe old and the legal design of it.This section explains the development and proposes the ideaof legal design within the legal framework.In the program designing, writer draws on theresearch of efficient decision-making model by Professor John Clayton Thomas.
