Since the Ordinance for Government Information Disclosure of PRC was passedin January, Our Country’s government information disclosure system was begun tonational from local government administrative in their own way and lack ofco-ordination over the whole country. The pass and implement of the ordinanceestablished the system of our government to disclose the government information.However, there are still problems in both current legislation and enforcement.Emperor Tai Zong (627-649) of the Tang Dynasty once said a piece of copper mirrorsthe tidiness; histories mirror the rise and decline of societies; other people mirror one’swin and loss. There was thirty years passed by since the Access to information Actpass and implement,from that day in1982,Canada has established a fairly completelegal system of government information disclosure. The similarities on legislationbackground and the relation between the central and local authorities on theinformation between China and Canada,set people thinking how the governmentinformation disclosure system of Canada work? What feature it has? Is there anythingworth us to study? Can we foresee and avoid the problem it once faced? Just undersuch background, this article go on with the discussion through translating andstudying a large number of Canada administrative law scholars’ monographs andpapers, and strive to make China’s government information disclosure system canlearn from the key point of government information disclosure system of Canada.In the specific structure, the article is divided into four parts to start discussion.The first part mainly introduce the background, the development and the legislativeprocess of the system; the power division between the central and local governments;the purpose and principles of information disclosure, and seek to find a commonprocedural rules for the whole system so as to overcome the disorder and arbitrationof the system. The second part give priority to Access to Information Act, the subjectof the right and obligation, the range and the process of information disclosure, as therelief system are mainly examined. Meanwhile, they are compared to the interrelatedregulation in our information disclosure system, to find the defectiveness in ourlegislation. The third part introduces the good results it comes and the measures ittakes to promote the disclosure of government information when face all the difficult,details these implementation status and development and the position of Canada’s government information disclosure system in the whole world. The last part try to findthe connection between the practical situation of china and the experience fromCanada’s government information disclosure system, to learn some useful andappropriate experience to improve government information disclosure system ofChina.
