Religion and law, as one kind of social ideology, are interacted on eachother, which is inevitable. The relation between religion and law in The OiratLaws is very obvious. The Oirat Laws is established in1640, under theinfluence of the Yellow Sect. It sets up the principle of laws and a lot ofbeneficial clauses for Yellow Sect. After that, The Oirat Laws plays aprofound influence on Mongolian society, politics, economy and culture.This paper talks about the research achievement on the relation betweenMongolian religion and law, and analyses The Oirat Laws and its establishedhistorical background and causes at that time. Through the analysis of thereligion clauses of The Oirat Laws, it explains that The Oirat Laws hides theclass character of law in that ‘it is beneficial to all creatures’, thus, exploresthe essence of ruling class. When the discussion of the relation betweenreligion and law, we take an example of The Oirat Laws to analyze from twoaspects: the impact of Yellow Sect to Mongolian law and the impact ofMongolian law to religion. And then we know that the Yellow Sect plays aninstructive principle role at that time. What’s more, after that it has greatinfluence on the development and changes of law. However, the Mongolianlaw maintains religion interests to protect the Yellow Sect, and with law clauses to ban Shamanism, then responses to the Yellow Sect’s dominantposition.Therefore, in the class society, both law and religion are the socialideology of superstructure, and they are also the behavior specification ofhuman. Religion, which is one kind of cognitive heart to regulate and controlbehavior through beliefs and faith, is universal. While law is a kind ofexternal compulsive force to control people’s behavior. In the class society,the ruling class takes the influence of the relation between religion and law topreserve own class’s interests. At last, this paper introduces the historicaleffects and realistic significance on the study of the relation between religionand law.
