Since2003, Jiangsu, Shanghai, Sichuan and other court, under the constantly trying to innovation, judged the quality and effect of quantitative into concrete and related indicators, formed a relatively complete evaluation system. In2008, the supreme people’s court on the basis of summing up the experience of around court, established "on the guidelines for the conduct of the case quality evaluation (trial)", it Shows across the country has already begun to establish a unified, standardized system of judicial appraisal.In view of the all sorts of problems and shortcomings about the current performance evaluation system of the judge in practice, In order to the performance evaluation system of judge belonging to Sanmenxia city intermediate people’s court of Henan province for the template, through making a analysis about the performance evaluation system of the judge, pointed out the problems in the actual operation, in reference to other countries or regions on the basis of related systems, put forward corresponding improvement measures. In does not affect the judicial independence and judge independence, to implement effective management of the judge,to further promote the process of judicial reform and better realize the rule of law, fairness and justice.This article mainly is divided into five parts, specific content as follows:The first part:overview of performance evaluation system of the judge, according to China law dictionary explanation of the performance evaluation system of the judge, analyzed this system should have the specific content. Through discussing the development process of performance evaluation system of the judge, the analysis of existing theory and the practice basis, On the one hand, there is a general picture of understanding about the trajectory and the current situation, on the other hand, it can also offers a research background to the research question.The second part:the empirical analysis of the performance evaluation system of the judge, in Sanmenxia city intermediate people’s court for the sample, this article carries on the system elaboration and analysis from the five aspects, including the evaluation target, evaluation subject, evaluation methods, evaluation and assessment content and assessment results using.The third part:the problem analysis of the performance evaluation system of the judge, from the important factors affecting the development of the system, the security administration of the operating environment and entrepreneurial management two aspects, according to analysis the problem in the implementation of the performance evaluation system, including evaluation of the "double track", evaluation content is scientific, digital audio, evaluation method, and evaluation index system to assess the internalization of the organization, brought the negative influence by the running process.The fourth part:reference the performance evaluation system of the judge from the country or the area outside, by choosing the United States, Germany and China’s Taiwan region of judge evaluation system as a system of Anglo-American law system and continental law system countries for examination and assessment of judges, analysis the specific content of the judge evaluation system, from which get some enlightenments.The fifth part:to improve the performance evaluation system of the judge, propose the basic principles of performance evaluation system of the judge, build scientific personnel management system, According to the problem of the current performance evaluation system in the running process, put forward specific improvement measures.
