This paper has studied our country existing volunteer legislation and practices in western advanced countries. Starting from the perspective of social work, research issues related to protection volunteers right in china.The pace of development of China’s volunteer service is so quick that makes us surprised. In practice, it appeared kinds of problems in the process to provide voluntary services and there must be legal adjustment. First, we can define the basic definition of the concept of volunteer. According to the United Nations definition of volunteers, what we should emphasize is the basic characteristics of volunteers and volunteer service, and it is free of charge. Free of charge is the fundamental basis of the volunteer rights laws. Secondly, throughout the development of the world volunteer, at present the development level of China’s volunteers and voluntary service is not just as one wishes. Especially in the field of protection of the volunteers rights, although many, but also the introduction of relevant legislation, the overall level remains to be improved in order to solve all kinds of volunteers to protect the rights of emerging problems in practice. The author gave a comprehensive analysis of the advanced practice in western countries about the volunteer legislation. We can found that, the main way to push forward the development of volunteer service in developed countries is setting of legal norms, to realize standardized institutionalized and procedures management. This point in the volunteer service practice is worthy of reference for China in the future. Finally, based on the reality of China and foreign legislative experience on the protection of rights of volunteers we can think about the legislation in our country, including the establishment of "legislative principle of weighting method", defining the legal status of volunteers, clearly the rights and obligations of volunteers, and establishing mechanisms to protect rights of volunteers.
