Study Of Legal Construction In Tibet

Tibet and the legal system is an important part of the construction of China’slegal system. Strengthen the construction of Tibet’s legal system is conducive tomaintaining a healthy economic and social development in Tibet, the protection ofthe legitimate rights and interests of the masses of the people. Since1949, the reformand opening up30years ago in Tibet in building the legal system has madegratifying achievements. But as a whole, the legal construction of Tibet are stilllagging behind in the economic development of Tibet, now combined with my actualwork in Tibet, the use of scientific theory to study the problem of legal constructionin Tibet, has a certain theoretical and practical value.The paper is divided into five parts: The first part is an introduction, includingresearch background and significance, research status, research ideas and researchmethods and thesis innovation and shortcomings. The second part is the basic theoryof the building of the legal system, the difference between the concepts of law andthe rule of law, the legal system and the rule of law, the concept and the basicrequirements of the socialist legal system. The third part is the history and currentsituation of Tibet’s legal construction, first described the history of the legalconstruction in Tibet from the the old Tibet hierarchy and the legal system ischaracterized by two aspects are described. The old Tibet strict hierarchy distinct andold Tibet harsh penalties for exposing the feudal serfdom in old Tibet inhuman. Onthe other hand revealed the system of old Tibet "theocracy" a direct result of theprevalence of Buddhism in Tibet, but also from the reflection of far-reachinginfluence of Buddhism in Tibet’s legal construction. Then expounded the status quoof the legal construction in Tibet, including Tibet legal construction achievements ofthe problems and the legal construction of Tibet and cause analysis of twoaspects.Identified the peaceful liberation of Tibet Autonomous Region in1951, theimplementation of the system of regional ethnic autonomy in Tibet, the victory of thepolitical system reform and the implementation of the socialist economic system inTibet, the perfect echoed the important results of the legal construction of Tibet."Gains will be lost, also there is a little problem in the legal construction in Tibet, such as the development and implementation of separate regulations are not perfect,the lack of legal publicity and education work. The author also analyzed the reasonfor missing the weather, geography, and problems. The fourth part describes theauthor about Tibet legal construction measures: special decree of the NationalAutonomous Areas; strengthening the rule of law publicity and education activities;strengthen the training of personnel of Tibet College of Law. The fifth part is thesummary of this article.
