Study On The Legal System Of Chinese Food Safety Incident Government Emergency Disposal

The Government issued the" food safety focus in2012clearly arrangedto improve the government emergency response capacity. This article is based on thesituation of food safety and the adjustment crossover between the "Food Safety Law"and the Emergency Response Law. Thus, this paper is based on fully illustrated theneed on Government’s emergency legal system of food safety incidents.Byanalysising on the legal subjects and program andcombining with the foodbornediseases and food contamination cases, this paper identify the problems that exist inthe legal system to deal with emergencies. Then,with comparative analysis of theemergency disposal legal system in Taiwan and the disposal of the plasticizer incident,it finally gives the recommendations to improve on the laws and regulations, theemergency procedures and the relevant mechanism.
