| Education-law relationship is a kind of complcx legal relationship. In order toensure its proper performance, multi-channel and systematic legal relief system need tobe established. Though the basic framework of educational complaint system hasalready been established, it is far from perfect, and shortcomings and insufficiencyappear in the educational practice. To meet the objective need of administrativeeducation and school according to law,educational appealing system should be furtherimproved to realize fairness and justice of education-law relationship.At ifrst, the paper puts forward the main academic problems which need discussing,including problems of educational appealing system at present and countcrmcasurcwhich could further improve educational appeal ling system. The paper reviews andcriticizes related literature on the subject, compares and refers to reseacrh and practiceof foreign appealing system, and illuminates the signiifcance and defines the coreconcepts such as appealing system and educational appealing system.. The paper usesmany research methods to explore the nature, characteirstics and classification ofeducational appealing system and analyze relationship between it and other educationaladministrative relief system. Through leasing out present legislation situation andimplementation situation of current educational system, it summarizes the mainproblems of the current appealing system and analyze their reasons. At last, it putsforward countermeasure and suggestion to improve our educational appealing system,including setting up appealing committees at all levels, clearing its legal responsibility,norming the legal program of educational appealing system，adjusting the scopc ofeducational appealing, broadening relief channels of educational appealing.Educational appealing system has been nonstandard since it was established. Thereare a lot of problems, such as not widely practiccd and not fully performed. Thercscarch could not only provide an effective method of administrative relief fordisadvantaged educational subject such as tcachcrs and students, but also improve theintegrity of the educational administrative relief system. |
