Research On The Legal Problems Of The Government’s Responsibility In Social Security

The main body of social security system is diverse, which includes government, enterprises and individuals. As the modern social security system has the nature of public products and the function of maintaining social stability and fairness, it is a part of the market mechanism failure. It should be lead by government mechanism. The reasonable definition and gradual perfection of the government’s responsibility in social security is the important basis and premise of our social security system’s smooth transition and health and efficient operation.It has important significance in theory and practice for protecting human rights, safeguarding social fairness and promoting economic development. This article defines the government’s responsibility in social security mainly from active duty level, which should include legislative responsibility, financial responsibility and supervisory responsibility. And the legislative responsibility is the premise, the financial and supervisory responsibility is the core.This paper makes theoretical analysis of the government’s responsibility in social security government’s responsibility, studies and summarizes the successful experience of several countries that achieved good results in this field. After analyzing the he present situation and the problems of our government’s responsibility in social security, this paper uses the foreign successful experience for reference to put forward the measures to solve these problems and perfect our government’s responsibility in social security. Therefore, the paper was divided into four parts to describe the legal questions of the government’s responsibility in social security:The first part defines the meaning of government’s responsibility in social security and puts forward the contents and characteristics of the government’s responsibility in social security. Then it analyses the theoretical basis of the reasons why the government should assume the responsibility in social security.The second part analyses the government’s responsibility in social security of several representative countries. It makes a comprehensive elaboration of the specific measures in various aspects, including legislation, financial support, the supervision and management. And then it summarizes the foreign successful experience.The third part introduces the present situation of our government’s responsibility in social security, and makes legal analysis on the existed defects. Although our country has started to strengthen the government’s responsibility in social security, there are still lots of defects needed to be improved in legislative, financial support and supervision system.The last part puts forward several suggestions to perfect our government’s responsibility in social security. The most important and urgent is to improve the legislation to clear the government’s responsibility, strengthen the government’s financial responsibility, establish and improve the corresponding internal management and supervision mechanism. And we still need to establish the financial burden sharing mechanism between central government and local government to differentiate clearly their responsibility in social security, so as to provide the guarantee for the smooth operation of our social security system.
