Study On Migrant Workers’ Rights Protection From Government Behavior Perspective

Migrant worker problem is social problem with Chinese characteristics. Hundreds of millions of migrant workers are bearing China’s socialist construction work, which has great influence to China’s social and economic development. How to treat migrant workers will also eventually determine the success or failure of building a harmonious society in our country. But the problem of protecting the rights of migrant workers is more and more obvious, especially the absence of their economic rights, political rights and education rights has already been one of the important factors that hinder China’s harmonious society construction. For these reason, analyzing the causes of migrant workers present situation is meaningful.At present, the research in the academic circle at home and abroad on the absence of migrant workers’rights is concentrating mainly on migrant workers’ labor capital and China’s urban and rural system. Combined with the history and institutional changing background, this paper takes government behavior as perspective to analysis the reasons cause the absence of migrant workers’rights. Essentially speaking, the absence of migrant workers" rights is the embodiment of the institutional inequality, which is the result when the transformation is not thorough from the planned economic system to socialist market economic system. In the meanwhile, the government behavior in different historical period can reflect the changing of the inequality. Therefore we should analysis this problem from the government behavior in different historical period, and make deep thinking of the mechanism behind the government behavior.First of all, this paper makes a study of the current situation of China’s migrant workers’rights absence, making a systematic combing of migrant workers" current living status. Next this paper will analysis the inner logic relations between the current situation and government behavior in our country, putting forward the concept of institutional inequality. On this basis, making text analysis with our country’s series government behaviors since reform and opening up, especially the government documents in various periods, which including laws and regulations. After finding out the motivation and purpose behind the government behavior, it will be much easier to show how the migrant workers’ institutional unequal status develops step by step. Then this paper will take the western developed countries’ experience in the transportation process of citizenization of farmers from rural labor into urban labor such as Britain, the United States and Japan as example to learn, and put forward practical countermeasures to solve the problem of migrant workers’ rights absence and change migrant workers’ institutional unequal status.
