Legal Research Of Hainan International Tourism Island Pilot Zone

On November17,2011, the meeting of the leader group for constructing Hainan International Tourism Island unanimously agreed to confirm the Li’an District of Lingshui County as the starting pilot zone for Hainan International Tourism Island. which is planned to cover65square kilometers with the39.6square kilometers of it for development. Focusing on the cultural industry, the pilot zone will explore the deep integration of tourism with culture and build the trial area into a demonstration site for innovative systems and mechanisms in ten years, a pilot zone for constructing the International Tourism Island, the largest clustering area for cultural industry in China, a demonstration district for the coastal city, and a world-class holiday resort.The paper is divided into four parts:First, it is wrote about comprehension of the pilot zone, in which analysis of the concept of the pilot zone of the International Tourism Island will be given. Then, there is a comparative analysis between the similar concept with the concept of the pilot zone, in order to further clarify the concept of the pilot zone.Second, the article introduces the construction and innovation of the the pilot zone, and it points out the scientificalness and innovation of the first-attempted five areas of Hainan International Tourism Island, as well as its significance for the International Tourism Island to become a large scale, highly-opened, and world-class national tourism and cultural industries concentrated area.Third part is about the defects in the construction of he pilot zone, which involves five aspects, including the lack of cultural legislation and tourism product innovation, many limits on private enterprises entry, the backwardness of financial services, and inadequate tourism supervision.In the forth part, the article raises legal suggestions according to previous question to make the construction of the pilot zone better.For instance, improving the culture and legal system, and the developing cultural and creative industries, as well as deepening reform, strengthening financial services project construction and the tourism supervision.This paper taking the pilot zone of international tourism in Hainan Island as the research object,to explore the legal problems in the process of building the pilot zone and the way to deal with, has a certain theoretical value and practical significance.The innovation of this article is according to the actual situation of Hainan,and proposing to relax market access of private enterprises, strengthening the support for private enterprises; extending the financing channels, financial services and in line with international standards; Improving the tourism insurance system, and finally to build a comprehensive tourist service quality evaluation system.
