SWOT Analysis And Measures On Hainan Province Tourism Legislation

SWOT analysis is a systematic, highly structured and easy-to-operate method whichaims to decide the best strategy by comprehensively analyzing and evaluating factors insideand outside the system. S stands for strength, W represents weakness, O representsopportunity, and T represents threat. Legislation is a static protection in the social dynamics.Introducing SWOT analysis into legislation theoretical research not only enables dynamicanalysis of society, but also achieves innovation of legislative research methods. It candirectly reveal the strengths, weaknesses, opportunities and threats of the legislative systemand helps in exploiting to the advantages, avoiding the disadvantages, seizing theopportunities, and meeting challenges through analysis.This thesis focuses on the use of a SWOT analysis, in combination with existingliterature, theoretical analysis empirical analysis, normative analysis, historical analysis, valueanalysis and other research methods to study the current tourism legislation in Hainan. Theanalysis results show the following main advantages: dual legislative power in Hainan locallegislation, initial formation of Hainan tourism legislative system and interaction betweenHainan’s “small government, big society” and the market economy system and insufficienttheoretical support of the tourism Legislation is now faced with important opportunities suchas the strategic development of international tourism in Hainan Island, the deepening reformof the Chinese legal system under WTO and a good environment for the development oftourism in Hainan. At the same time, there are challenges like frequent social conflicts, higherrequirements that the internationalization of tourism poses on the legal system, and higherstandardization of local legislation after the formation of socialist legal system in China.In response to these problems, this thesis adopts qualitative, quantitative, and valueanalysis to draw scientific measures that can help to improve the tourism legislation in Hainan.These measures include but are not limited to: implement “sophisticated” tourism legislation;make the best of the legislative power granted to the Hainan Special Economic Zone; tourismlegislative response and innovation under the new situation; and drawing on the advancedlegislative experience and supporting systems.
