Study On The Rule Of Law Construction Of Service-oriented Government In Ethnic Regions

The concept of "service-oriented government" has been put forword in China’slocal government and academic at the beginning of this century. In the new era underthe background of the rule of law, the purpose of the service-oriented governmentis to provide the public satisfaction within the legal framework of the publicservices, service-oriented government construction must take the path of the ruleof law. Ethnic minority areas construct a service-oriented government must be withinthe legal framework to adjust measures to local conditions because of its specialsituation, mood. Due to the unbalanced economic development in national regions,the restriction of traditional concept, combined with geographical, human feelings,the limitation of comprehensive factors such as customs, carried out on theconstruction of service-oriented government under the rule of law path research hasimportant theoretical and practical significance.This article takes JianShiXian of enshi tujia and miao minority autonomous asan example, analyzes the status quo of the construction of service-orientedgovernment under the rule of law in ethnic areas, are summarizes the existingproblems, deep mining the barrier factors in the process of development, probes intoits path to the rule by law. This paper is divided into four parts:The first part introduces the basic connotation and characteristics ofservice-oriented government, analyses the relationship between theservice-oriented government and the rule of law theory: one characteristic ofgovernment is a service-oriented government under the rule of law, service-orientedgovernment is the necessity of rule by law.The second part summarizes the practical experience of a service-orientedgovernment under the rule of law in the process of exploration of JianShiXian. Thispart mainly identifise how to build a service-oriented government under the ruleof law path in less developed ethnic minority through on-the-spot investigation andcollecting data: changing ideas, streamline institutions, optimization, and promotescientific and democratic decision-making, simplify procedures, improve the serviceefficiency, perfecting the responsibilities, establish and develop the socialsecurity, strengthen supervision and improve the working mechanism, build systemof administrative leader to appear in court investigations, strengthen theadministrative responsibility.The third part mainly mining obstacles and reasons in the path of aservice-oriented government under the rule of law still exists, such as: the conceptof change is slow;"Dislocation" and "offside" of government management, thephenomenon of "vacancy" still exists; Government administrative personnel serviceability and level is not high; Government performance evaluation mechanism is notperfect; Public services form a single, low degree of social participation;Insufficient system of long-term construction, etc.The fourth part explores the path of service-oriented government under the ruleof law in ethnic minority areas how to start according to the above problem? Firstly, we should from the concept of reform, to strengthen the construction of aservice-oriented administrative culture, set up transparent administrative concept,establish service as the core of administrative value orientation. Secondly weshould make longer system improvement. This should change the traditional controltype government function, streamline institutions and personnel, the joint office,strengthen the cooperation and communication between departments; Improve the civilservice ability and quality, advancing the government performance appraisal legalsystem construction; Implementation of the public service marketization andsocialization, to introduce people to participate in governance. The third is toperfect the supervision mechanism of the construction of the service-type government,strengthens the local authority to supervise, strengthen the social publicsupervision, improve the system of letter-inquiring-and-accusing, improve thesystem of judicial response, correctional service government by in the path of therule of law.
