Research On The Problems Of New Types Bribery

In recent years, with the development of society and economy, the means of bribery become more concealment and complexity. It brings certain difficulties to the bribery case investigation. Therefore, the supreme people’s court and the supreme people’s procuratorate issued a package of targeted laws and regulations, such as:November13,2003, the supreme people’s court on the introduction of the "national court economic crimes work symposium summary"; On July8,2007, the supreme people’s court and the supreme people’s procuratorate issued "on the criminal case for bribery opinions on some issues of applicable law (hereinafter referred to as" opinion "), providing ten kinds of behavior qualitative processing problems; On February28,2009, the National People’s Congress (NPC) promulgated and implemented the amendments to the criminal law of the People’s Republic of China (7)". These problems are the new bribery case investigation and controversial problems often encountered, This paper explicitly addressed to clear understanding, timely investigate, punish all kinds of new bribery, It will help to curb this kind of crime to spread, and to promote the in-depth development of anti-corruption struggle. But at the same time, due to differences in complexity of new bribery crime and grassroots legal professionals on understanding, some differences and arguments caused in the judicial practice to define this kind of crime still exist. Therefore, it is necessary to do some further research and discussion, in order to unify the understanding, correctly applies the laws and regulations in judicial practice.This article is divided into five sections on the reference of the"Opinions". This paper uses methods of case study, literature searchand analysis. It gives a research on the transactional bribery, financial management type of bribery, the performance shares type of bribery, specific party bribery and bribery using influence. This paper discussed the problems of how to apply the law, and puts forward some suggestions, in order to do something against new bribery crime.
