Since the "United Nations Convention on Law of the Sea" formally came into effect, anew round of "blue enclosure" campaign kicked off again. Thus it opened up the global era ofvigorous development of the marine. In this process, China is still in a weak position. Thereare about half of the sea areas invaded by some foreign forces. And many countries takepredatory exploitation of marine resources under the hegemony. It should be noted that, thewaters in China, besides the Bahia belong to China’s inland sea, there are overlapping areawhich claims of sovereignty have dispute with eight countries in the other three waters. Inparticular, China is facing many urgent issues to deal with in the aspect of maintenance ofmaritime rights and interests: highly potential conflict of demarcation disputes in the YellowSea between China and North and South Korea. Especially in recent years, Korea and the U.S.are frequent to conduct joint military exercises in the exclusive economic zone of the ChinaSea. It is a serious threat to China’s national security; the maritime demarcation dispute existsbetween the East China Sea, including the sovereignty issue of the Diaoyu Islands betweenChina and Japan; large areas of waters in the South China Sea has been divided by some ofSoutheast Asia countries and were credited to their respective exclusive economic zones. Themajority of reefs are occupied by the adjacent sea state. In order to defend the national marinerights and interests beneficially, rationally and courteously, it is necessary to further exploreChina’s national security issues concerning marine areas. Therefore, China should scandevelopment situation of various Chinese maritime demarcation disputes, affirm strategicvalue of China’s waters security, analysis the existing marine national security issues, andmake target-oriented sea national security countermeasures creatively. And thecountermeasures include carrying out the United Nations Convention on Law of the Sea toestablish a harmonious maritime flags, strengthening the administration of marine rights andinterests to build maritime safety system, formulating a scientific legislative plan to acceleratethe improvement of marine laws and regulations, setting up high-level dialogue mechanism toimplement the concept of joint development, promoting “sea Mita” strategy to defendnational sovereignty of territorial waters and ruling out intervention by external forces toadapt to the marine of the times. This is the only way to uphold China’s maritime rights andnational security. It can soundly expedite economic and social development. China has thefoothold between the great countries of sea around world. We can be truly realized theOcean’s lofty ideal put forward by the ancient people.
