Protection Research Of The Rights Of New Residents On China’s Urbanization Process

In this paper, field survey method, defined induction, comparative analysis and other research methods, combined with China’s urbanization process produces nascent people’s real employment, pension, investigation and analysis of the living conditions of these new residents into the city after the employment, the difficulties faced by social security, causes and ways to solve discussed. This paper defines the concept of urbanization, urbanization theoretical and practical significance to study the development of China’s urbanization process, the analysis based on the characteristics of urbanization, through the survey analysis found that China’s urbanization process freshmen residents now face major difficulties there are some of the following situations:first, the land expropriation, farmers become urban residents after the decrease in revenue expenditure increases, the quality of life of residents some freshmen into a downward trend. Second, new residents in the town in which the employment situation is not optimistic, new urban hidden unemployment rampant. Third, the vast majority of freshmen residents do not participate in the economic capacity nor the sense of social security.Cause newborn urban residents into such difficulties main reasons are:land acquisition process did not reflect market forces. Government land acquisition process is not standardized behavior, ignoring the laws of the market, while the farmers lack the capacity rights. Land ownership arrangement is unreasonable," collective " so that farmers did not put himself as the owner of the land, rights awareness is not strong. Land requisition system is not standardized, the existing land requisition system is not standardized, mainly in conflicting legal provisions, the government executive power abuse, compensation standard is too low, the system is imperfect and land resettlement program is unreasonable. Therefore, for the rights of the residents to protect nascent Chinese authors propose the following:first, to regulate the government’s land acquisition act, clearly defined using the " land rights" range. Secondly, to improve the land requisition compensation standards in the process of land requisition compensation fully reflect the laws of the market. Again, a sound land acquisition procedures, enhance transparency, fairness. Finally, the establishment of urban and rural social security system to protect newborn residents and urban residents can enjoy the same social security benefits.
