Medical and health services is directly related to the health and life safety ofPeople. Safeguarding citizen’s basic medical right and regulation of medical serviceprice has become the duty of price competent department of the government.For along time,medical and health system reform has made rapid progress in China, themedical and health undertakings have been considerable developed. But the existenceof high medical expenses、overmedicalization，attracted more and more attention ofthe society, caused widespread controversy and strong dissatisfaction of the masses.In view of the present situation, this paper analyzes the main problems of medicalservice market, demonstrates the legitimacy and necessity of economic law is toadjust the medical service price, studys the regulation problem of medical servicemarket from the medical service price supervision legal system perspective, to explorea set of medical and health services legal system.The full text divides into four parts:The first part analyses the nature of medical service price and pricing mechanism.Firstly, expounds the pricing mechanism of the medical and health service price:introduces definition of medical service price and government price regulation;medical service price system in accordance with the price categories; differentclassification as the price category、level of medical and health service、difference of consumption object；the medical and health service price management system.Secondly, discusses the nature of medical service, accordding to the analysis of publicproduct, Summarizes the medical health service has the nature of quasi publicproducts,which is not suitable for complete marketization. Thirdly, analyses themedical and health service pricing mechanism, mainly discusses the features ofmedical and health service、price formation mechanism and supervision mode.The second part expounds the medical service price supervision. Economic lawhas the legitimacy and necessity of adjusting medical and health service price. Firstly,this paper discusses the failure of medical service market、 the nature of quasi publicproducts、information asymmetry between the medical health institutions and thepatient、unreasonable over treatment、maintain good medical service price order andfair competition, points out that Economic law has the superiority and practicality isbetter than the civil law. Secondly, from the evolution of medical service priceadjustment policy in China History, investigated in different social background indifferent price policy, and divides it into the expenditure stage (1949-1955), balancesubsidy stage (1955-1960), fixed subsidy stage (1960-1979), quota subsidy stage(1979-2000), fixed or fixed subsidy stage (2000-present). Thirdly, this paperintroduces the medical and health service supervision mode, and the United States,Britain, Finland, Singapore medical health service mode, concludes that the lack of aserious、shortage of resources、coverage is too narrow in medical and health servicesupervision of our government.The third part introduces and comment the present situation of medical andhealth service price supervision system. By examining the present situation of medicaland health service price charges, sums up the main problem. The main problemsexisting in medical service price charges;the main problems of drug price; non-profitmedical institutions have a monopoly position.It analyses the current price regulationsystem existing problems in the legislation of supervision、 the policy systemproblems、the conflict of price regulation、not fully implementing the system ofhearing, based on the current legislation and regulation on carding. The medical service price supervision legal system proposed in the fourth part.In this chapter, it puts forward a suggestion based on the above theoretical analysisand system summary. Such as Improving the medical and health service pricesupervision legal system；strengthening the refinement and control of administrativepenalty discretion； improving the health service system of medicine price; enhancingthe transparency of information to reduce the degree of information asymmetry.
