The Research On Deliberation System Of Local Legislation

Local legislation, which is one of local important political activity, is an essential part of legislative system in China. Since the founding of the People’s Republic of China, the local government’s legislative power has a process of development, which can be divided into3steps:Step1.1949-1954, central legislation and local partly-legislation of district was integrated, In Dec.1949, The PEOPLE GOVERNMENT LAW OF BIG DISTRICT issued by the Government Administration Council states that the regulations about the local government affairs enacted by people government of big district has tor be approved or recorded by the Government Administration Council. Step2.1954-1979, the legislative power has been controlled by National People’s Congresses. Step3.1979-now, the uniform and multilevel legislation system has been enacted. The LEGISLATION LAW formulated in2000prescribes fully the legislative system in China, regulates and improves the legislative activity of the state organs in local areas, which is a fatal revolution of legislative system in China, and is main content of system reforms in China. This revolution pushed greatly the legislative development of socialism.Legislation, a serious political activity, is a rigorous procedure, which ensures the democratization, science and effectiveness of legislation. At the same time, the deliberation ensures the legislation’s quality, which is a professional link of legislation and a process of democratization, is the key of legislation procedure. But during the implement of local legislation, the deliberation is often a formality. Due to the capability’s lack of deliberation subject, such as non-representative of committee member, the lacking of deliberation capability, no funds for deliberation, and the imperfect of deliberation system, such as the deliberation has not been fully publicized, the legislation deliberation can’t perform its function to the local regulation, so as that many low quality local regulations have been issued, which causes many issues. Most local regulations are of low value, and in a state of sleeping, which depreciates the law and wastes many social resources. This essay attempts to analyze the problems of local standing committees during the process of deliberation, suggests to straighten out the relationships between the standing committee and the government, the Party Committee, to set and raise the fund of deliberation, to publicize the deliberation, which will improve the deliberation function of local standing committee, improve the quality, authority and the effectiveness of the local regulation.
