The people are the root of the country,and food safety is what the people concern the most.Along with the rapid population growth and the rapid development of market economy,people's living standards steadily improved.At the same time,in the field of food safety,consumer rights still can not be ignored.Due to the commercialization,rapidity and technicalization of food and the development of agricultural products processing industry,coupled with the excessive profits and deeds of production and management,cases concerned with food containing the harmful elements harming life and health are constantly happening.For example,stool stinky tofu in 2007;"Dirty" ammonium bicarbonate swelling agent,Poisonous dumplings in 2008;water-injected meat and artificial pig blood in 2009;syrup dipped bean sprouts in 2010;toxic ginger in 2011;expired meat in 2014 and so on.So how can we feel confident about the safety of food,has became the focus and how to solve this is a epochal challenge.Obviously,food safety is undergoing a severe test.Under this background,in 2015,the "Food Safety Law"(hereinafter referred to as "FSL")was further revised and some part of the law has been modified and adjusted.Moreover,combined with the successful experience of foreign countries,the concept of food safety supervision,information disclosure and risk control are improved.Aiming at the new problems and challenges of food consumption in recent years,so that more and more consumers are able to get better relief in food safety incidents.But in recent years,incidents that have damaged consumers in food safety have been exposed again.To better protect food consumer personal property safety,this paper strengthen the supervision of food safety law of the practical,strengthen the functions of the government law enforcement efficiency,improve the food consumers relief way,improve the food safety supervision mechanism and measures and so on several aspects are discussed in this paper.This paper consists of four sections:Section one accounts for the basic concept of food security supervision.By comparing the existing theories and scholars' suggestions,this part defines the food,food security,food security supervision.Section two analyzes the legislative status and problems on the protection of the rights and interests of consumers in the field of food security in China.Based on the analysis of the current legislation of our country and considered the reality,this part sums up the problems in the protection of the rights and interests of consumers in China's food security supervision.The main problems are as follows:the law of food security criterion is not easy to carry out;the effectiveness of law enforcement is low;the resolution mechanism on consumer disputes is not perfect and the supervision mechanism of social organization needs to be strengthened.Section three induces the advanced experience of the developed countries in food security supervision.This paper mainly discusses experience in legal practice of the European Union,the United States and Japan and concludes the advanced ideas and practices which we can use for reference.Section four puts forward the suggestions on improving the food security supervision in China.This part puts forward some specific improvement suggestions,such as,to strengthen the cohesion and the specific legal system of food safety regulation,to enrich the law enforcement resources,to raise the standard of punishment,to improve the litigation system of food security company and to strengthen the self-discipline and supervision of trade associations and media and so on.Then,we can make up for the defects of consumers' food security rights relief system.
