The Right To Education Of Children Of Migrant Workers To Protect Demonstration

With the rapid developing of China’s economy, the gap between the urban and therural areas is also increasing. Many young adults move from the rural area to the city toseek more opportunities. The increase of the floating population makes the issue that itis difficult for the children who follow their parents or stay in the rural area to receivetheir education much severe. The unfair problems of the education have been a greatconcern of our society for a long time.The right of education is an internationallyrecognized basic human rights. Our Constitution makes the right of education as thebasic right of our citizens. In order to make provision for the right of education, othersingle-line legal also involves the right. In fact, whether has an access to education ornot is a close contact with events to one’s personal life, for our country it is also theresponsibilities and obligations. So the problem that the children’s right of educationcan not be guaranteed need to be solved quickly, or it will affect not only the children’sgrowth and development, but also our country’s prosperity and social harmonythrough the family as a social cell. My paper first describes the basic theory of the rightof education and the theory of migrant worker‘s children‘s right of education. Then finda legal basis from China’s relevant laws to protect the right of education of the migrantworker’s children in China. After that， I analysis the situation and the reasons of theright of those children’s education. At the end of the paper, I try to make somesuggestions from the angle of legal, the institutional level, their own factors of thechildren and social to expect a help to the protection of the migrant worker’s children’sright in China.
