| Protection of human rights issue has always been the most basic and the most cutting-edge study of the human rights, because it is directly related to the scientific study of human rights and affects the progress of human rights protection mode direction. Currently, there is a serious disagreement in human rights protection mode, such as the lack of common understanding on the concept of human rights between East and West, and there is no clear systematic pattern of human rights protection, especially because of social, historical, economic, political factors that national human rights protection mode showing a diversity trends. The constitutional amendment passed on March14,2004, introduce the "human rights" concept into the Constitution for the first time, and clearly states that "the state respects and safeguards human rights", based on this, I chose writing this thesis.Thirty years of reform and opening protection of human rights practice, let us be more profound in understanding the importance of human rights, and experience more personal to the cause of human rights protection in China’s great achievements, let us more look forward to the better development of China’s human rights protection. At the same time, we need to know and understand what is human rights protection "China model"? And by summing up the "China Human Rights Protection Mode" the unique experience of how to construct a reasonable system of human rights theory with Chinese characteristics? What are the implications in the process of extraterritorial constitutional protection of human rights protection in China? To know what are the factors that restrict the development of China’s human rights protection? How to explore the development path of China’s human rights protection? This article is start from the above questions on the constitutional protection of human rights in China and the author’s perspective opinion about the problem is also discussed. |
