Along with the implementation of the Labor Contract Law, all individuals ingradually knew the labor dispatch. How to protect the interests and rights of thedispatched workers, has become academic and legislative circles proposition concern.Collective labor rights of the dispatched workers are the binding studies on bothdispatch labor and collective labor rights.This study started at dispatched workers’ collective labor rights protection.This essay has five chapters. In the introduction, it depicts the research background,the significance of the dispatched workers collective rights to work, a brief analysis ofthe current research status, and to clarify the focus of this topic. The first chapterstarts form the meaning of the concept of core cut, and described the two conceptssurrounding the labor dispatch and collective labor rights. In the first chapter, itincluding the concepts, features and special protection of labor dispatch. The firstchapter also described the concept of collective labor rights and its next level concepts.The second chapter lists a brief introduction on scholars’ theoretical debate on thisissue. The second chapter could be divided in three opinions as the trade union, theunion in working palace and allowing workers to join labor units free. The thirdchapter describes the existing legislation and its authority. The third chapter describeslies a review of existing legislation with the introduction and evaluation of the unioncommissioned escrow mode. The forth chapter introduces the analysis, the experienceof the three places, in the United States, European Union and Japan on dispatchedworkers the right to collective labor. In which the EU part, it introduced experience ondispatched workers protection in Germany and France. In the fifth chapter, itcombined with China’s actual situation, try to make recommendations on Chinadispatched workers the right to collective protection. In this part, it includes theclassifying protection from the three characters of the dispatched workers, andstrengthens the role of the collective agreement and perfect union commissionedescrow mode.
