After the founding of new China, due to the social stability, economicdevelopment, improving people’s living standards, especially the improvement ofmedical conditions, the number of elderly people increase sharply. In1985China’saverage life expectancy is68.9years old, and in2013it’s75years old,28yearsincreased by6.1. With the development of economy, the average increase in lifeexpectancy of our population is an inevitable trend. It can be said that our society hasgradually entered the aged society. Young labor force is gradually shrinking whichmakes retired re-hirement become a common phenomenon of employment. Once bere-hired, retirees will be inevitably faced with the problem of the protection of theirrights and interests。First of all, I put forward the focus of dispute which based on the case that theretired workers have been rehired which receives different sentences in two differentprovinces. That is the restart retirement is either the labor relationships or the servicerelationships, and I have made the exposition of each one, a comparison of them, andproposed my own view that the restarted retirement should be defined as laborrelations on the basis of the comparison, and make an overview of it,which includesthe conception and characteristics of restarted retirement.Then expound thesignificance of the restarted retirement that it achieves a win-win of entity andindividual, which reduced both the retiree’s survival pressure, and solved thecontradiction of talent shortage of unit, which is also conducive to the stability andprosperity of the market economy.Then,the author analyzes simplely foreign retirement system in the hope ofhelping establish and consummate the retirement system in China. Finally, the author points out that the absence of national legislation is the reason thatthere’s no protection for this labor group by means of the analysis of China’s currentretirement system legislation, and further the different legislation in localgovernments not only damage the interests of retirement, but also seriously affect thenormal development of social economy, increase social operation cost and increasethe risk of the society. To solve these problems, the author puts forward somesuggestions to consummate the retirement system on the principle of fair employmentand the protection of labor rights. The paper discusses this issue on two facets, one isthe consummation of related retirement system legislation, the other is retirementsystem facilities.The first part mainly talks about is the nature of retirement system, expandingthe industrial injury insurance coverage, special legislation for retirement system andthe retirement pension system. The second part mainly talks about the ways toimprove the related retirement system facilities in China which includes standardizingthe procedure of retirement program and the establishment of special agency forservice and management.
