The Study About People’s Legal Aid Of Mandatory Drug Isolation

Legal aid, as an important legal system in maintaining thelegitimate rights of the people in straitened circumstances and ensuringsocial fairness and justice, is known as Project Hope and Sunshineproject in legal profession. People under mandatory drug isolation havetriple identities as the offender, the victim and the patient and are thespecial disadvantaged groups. However, it did not arouse publicattention about whether people under mandatory drug isolation should fitinto the scope of legal aid and how to help them effectively, and whathave explored and attempted are only limited within the mandatory drugisolation field, which is also the main purpose to write this paper.This paper aims to put forward a concept to perfect the legal aidsystem of mandatory drug isolation by analyzing it’s necessity andimportance, and it’s present situation, including problems anddifficulties in China. Approaches such as case study, literature reading,empirical investigation and text analysis are used during the analysis.There are four chapters in this paper:Chapter one: summary about legal aid to people under mandatorydrug isolation. Based on the legal aid theory, the legal status of peopleunder mandatory drug isolation and the present situation for their legal aid are analyzed, which is the preparation for the following chaptersboth in theory and in practice.Chapter two: necessity and feasibility for the legal aid to peopleunder mandatory drug isolation. As the vulnerable group, these peopleare limited in legal liberty and have the realistic demand for legal aid.Approaches such as legal theory analysis, empirical investigation andcase interview are used in this part.Chapter three: constraints on legal aid to people under mandatorydrug isolation. Constraints on legal system and practice aredemonstrated in detail, which hinders the development of legal aid topeople under mandatory drug isolation.Chapter four: concepts to improve the legal aid to people undermandatory drug isolation. As the key chapter, this part discusses how toimprove the legal aid from the legal system, practice and securitymechanism, meanwhile points out the concepts to incorporate the legalaid into the functional area of mandatory drug isolation field, build legalaid system in different levels, and broaden the scope of the legal aid.It is hoped to achieve the following objectives by the analysis offour parts in the paper: First, draw the government and society’sattention to the legal aid system on people under mandatory drugisolation, thus to orientate and implement on it legislatively to serve forthe ultimate goal of ensuring social fairness and justice. Second, it is beneficial to build a fair, convenient and complete legal aid system toprotect their legitimate rights and improve the development of themandatory drug isolation cause.
