It has brought serious harm to the state administrative management.“The civil servant law of the People’s Republic of China” has issued by the relevant provisions of our country, including on April27,2005, and through by the tenthNational People’s Congress at the15th session of the standing committee, chapter11:sixty-eight to seventy-two. But this provision is still very short, and is said to have vulnerabilities in the system and implementation. Civil servants avoidance rules (trial) introduced in February2012and it is the current law of our country. In this paper it doesa more comprehensive and detailed for China’s civil service avoidance system to do. This article through the analysis of the connotation of public administrative avoidance system, expounded the content of public administrative avoidance system and analysisreflect the value of the system itself. By examining system evolution in the history ofour country, and after the founding of the system evolution analysis, research the current status of official withdrawal system, it is existing problems and its reasons. By comparing the similarities and differences between western countries public administrative avoidance system, for our country is suitable for the situation of public administrative avoidance system oneself make matting.
