Research On The Application Of The Parole System

The parole system as a penalty executing system, can promote the criminals topositively transformation, and prompt them to return to the society as soon aspossible.At present,the parole system have a relatively large gap in the criminallegislation and the practice of the execution,compared with the western developedcountries. This paper analyzed and discussed the status of China’s parole system aswell as the outstanding problems in practice through the method of empiricalanalysis.Then this paper combined the theory of the parole system with thepractice,put forward some recommendations to solve these problems perfectly,inorder to achieve the value of the parole system.This paper discussed the following:Part One:Overview of the parole system.This part introduced the theoreticalbasis of the parole system briefly,discussed the development process and thecharacteristics of the parole system in our country in detail.The parole system wasproduced in middle of19thcentury.It was the product of the educational punishmentidea.In our country,it established and developed in the early20thcentury.So far,theparole system has become increasingly mature sound after many years explored anddeveloped.Part Tow:The problems in applicable process of our parole system.First,byanalyzed a series related data of the parole,it could come to a conclusion that thecurrent situation of our parole system was the parole rate in our country been lowly.Itwas a great distance between the expectations of the legal effects with thestatus.Secondly,it discussed the problems of our parole system in the applicableconditions and the problems during the execution in detail,such as the conditions ofparole were harsh or the regulations of them were not clear;the application of parolein the executing process were too long;Community Corrections also had someproblems in the running of parole system.The existence of these problems means that the parole system could not play its supervision and protection for criminals verywell,and that the parole system in our country did not play its due.Part Three:The reason analysis of problems in the applicable of our parolesystem application.This part analyzed the reasons of problems in our parole system inthe application,mainly from the penal theory and the public’s thinking perspective.Part Four:Suggestions for improvement of our parole system.For the existingproblems in parole system above this article,this part put forward suggestions forimproving our parole system.It needs us to be updated the idea of our penal,to reformour parole system from the contents of the legislation and the judicial proceedings.Itneeds us to play an active role in Community Corrections and to realizing the rights ofthe criminals on parole.
