China was in the feudal society for thousands of years, Confucianism is themainstream of the feudal society thought, and the Confucian ethics system centeredon king-subject relationship and father-child relations, every-one must obey the "threecardinal guides and preaching", which fettered people’s thinking. In China, the stalebelief that men are superior to women was deep-rooted, women should not only bemild but also to obey. Oppression and pain imposed upon women by the feudalmarriage system is more severe than men.Shandong is the birthplace of Confucianism, feudal ideas had carved into Shan-dong people’s mind deeply and impacted on generations of people all aspects of life.In recent history, Shandong province has experienced the baptism of war and theimpact of western civilization, but the feudal thoughts still occupy the main position,the reason is the unique traditional culture of Shandong has long-term stability.However after decades of Shandong, modern civilization exists everywhere."Male superiority, wifely submission and virtue, early marriage, child bride and soon", all of these sounds are so far away. Looking around the life, the women’s statusin the family is even higher than men. Women have room of themselves, also theirown business. They get married generally between25to30years old. For women inShandong, the feudal marriage and family system was abolished for over a thousandyears.What changed the marriage and family in Shandong so miraculously? To solvethis problem, we should research from the Marriage Law of the PRC which is enactedin64years ago.On April13,1950, the central committee of the people’s government of theseventh conference passed the "Marriage law of the People’s Republic of China". It isan important legislation of the period of the new-democratic revolution, also is thefirst law of new China. The basic principle of the marriage law is to abolish the feudalmarriage system, implement the freedom of marriage, monogamy, equality betweenmen and women. Its legislative spirit is to overthrow the "masculine" for the center with men, to protect the legitimate interests of women and children. But at that timeof Shandong province, the Confucianism is powerful for people. It was extremelydifficult to perform a brand-new new-democratic marriage law. However, it is thisreason that makes the study of this paper be a typical case. Based on the limitedhistorical archives, this paper systematic tidies the situation of publicizingand implementing on the new marriage law in Shandong province, tries to truthfullyreproduce the history and preliminary studies the relationship between law andtraditional culture. At the same time, this paper discusses the rule of marriage-familychanges in Shandong province, hope to help the China’s legal construction ofmarriage-family and harmonious society.This paper consists of four parts:Part1: Under the effect of Confucianism, this paper first introduces thefeudal marriage-family system in China. After the recent history, because of constantwar, foreign civilization was brought into China by aggressor. Under the historicalbackground, different periods of rulers successive make reform to China’s marriage-family system, which lead to the new ethos in Shandong’s marriage-family. Butgenerally speaking, the feudal marriage and family still occupied the main position.Part2: The " Marriage law of the PRC" enacted in1950, and then shandongprovince responded actively to the calling of the Government, started publicity andimplementation of the Marriage Law. Shandong province primarily publicized andimplemented the " Marriage law of the PRC" from May1950to September1952.Remarkable achievements had been made, but inadequacies were also very obvious intheir work, mainly a sense of contempt for work, wrong view of the Marriage law,without unified leadership and systematic organizations,and so on. During this period,women heavily suicide or were killed by others, and is paid attention by thegovernment.Part3: This part mainly discusses related work of "the Month for implementationof the marriage law " in Shandong province, And they prepare the job from October1952to February1953."The Month for implementation of the marriage law"officially started from March1953to May1953, Shandong governments at all levels publicized and implemented the marriage law in the light of the local conditions,densely and effectively.Part4: Overall, the publicizing and implementing of the marriage law from1953to1953in Shandong province is active and effective. But historic limitation andshortcoming are always unavoidable. In this chapter, the author detailedly commentson Shandong’s movement of the propaganda and implementation of the marriage law,including its effectiveness and deficiencies.
