After the founding of the People’s Republic of China in 1949, the Central Government promulgated "Marriage Law of People’s Republic of China" in 1950. The purpose of this law was to liberate thousands of young men and women, especially those of women, from the cage of "feudalism" and get them involved in the project of national construction.After the enactment of this law, the government quickly launched a vigorous nationwide movement in order to implement the Marriage Law. In this article, I used historical archives of Shandong Province to analyze the Marriage Law Movement in this area.Women’s "subjectivity" in the Marriage Law Movement is the focus of this article. The first chapter discusses the ideological origins of the Marriage Law, and makes an overview of the movement in the country as well as in Shandong Province. This chapter also talks about the specific practices of marriage law movement in Shandong Province. The second chapter defines the concept of the "subjectivity" and analyzes women’s "subjectivity", including how it was constructed women and how it showed in practice in the marriage law movement based on the case from the archives of Shandong Province. The third chapter concerns about the influencing factors of women’s "subjectivity" respectively from the perspective of politics, history and law. The emphasis of "labor-production" and the rise of a new class discourse, the traditional notion, and the deficiency of the country’s legal system and legal awareness all matter. The fourth chapter emphasizes legal analysis, starting from the legal texts and legal practice, combined with the legislative purpose, I analyzed of the Marriage Law’s shaping of women’s "subjectivity". |
