China has entered the aging society, the aging population is increasing at anannual rate of8million. Due to changes in family structure, many families faced withthe phenomenon that fewer young people need to support more old people. Familypension mode gradually shifts to institutional pension model. Rigid pension demandfor social services is also increasing, pension institutions came into being in thissituation. Private pension institutions, as an important complement of public pensionagency, meet the pension needs of some of the elderly. It is an important way to solvethe pension problem in our country.This paper defines the nature of pension institutions as a starting point, makes ananalysis of the non-profit of private pension institutions according to "Permission forpension institutions established" that the civil affairs department released. Thenthrough empirical analysis, combined with some cases in reality, the status quo ofChina’s private pension institutions were described and analyzed. All along, thedevelopment of the private pension sector is very immature, lack of relevant laws andregulations, there is a big gap compared to Public pension institutions, such as funds,facilities and the degree of specialization of employees. Many reasons are restrictingthe development of private pension institutions, both institutional and the lack offunds, a large population base is also an important factor. According to theperspective status of private pension institutions, they need administrative supervisionfrom the government.2013Ministry of Civil Affairs issued two regulations aboutpension institutions, include some new rules about the access and management ofpension institutions. In the respect of legislative proposals about private pensioninstitutions’ administrative supervision, the paper put forward reasonable proposalsfor regulation of private pension institutions by combining with the relevantprovisions of the new law and drawing on advanced management system of foreignpension services industry through comparative analysis. On the establishment of the regulatory regime, this paper proposed improvement of the access system, alsoproposed the development direction of China’s private pension institutionssupervision mechanism by combining with supervision and evaluation mechanism forthe United States and Japan. Financial matter of private pension agency has been theprimary problem in the process of operation, its financing channels is limited bycertain legal provisions limitations because of its nonprofit, the system’s problemneeds to be resolved through the system, this paper should make more tolerant ofchanges to the existing provisions on the basis of understanding private pensions’"nonprofit" reasonably, to further expand financing channels. After drawing theUnited Kingdom and Hong Kong and other regions provisions on pension agencystaff, China’s private pension institutions nurses training system, special care systemwas further suggested in this paper. Pension institutions is a high risk industry,frequent injuries led to a lot of old-age service disputes, this paper put forward theirown views on disputes settlement mechanism of pension services. In the process ofthe establishment of the system, there are many issues that need attention, and not beso anxious, can not act in isolation, to look at the problem and solve the problem by adevelopmental and comprehensive vision. The government should also focus on thesupport for private pension institutions while supervising it.The pension issue relates to the immediate interests of millions of householdsand social harmony and stability, the government plays an important role in theregulatory process of private pension institutions. This paper analyzes the problems ofprivate pension institutions’regulation from the legal point, puts forward reasonableproposals for private pension institutions to by combining the experience of Westerncountries in terms of social pension service. The writer hopes her papers to causedeeper discussion and wider attention about private pension institutions, and hopeprivate pension institutions on the development path of legalization, standardizationand specialization.
