Study On The Legal System Of Administrative Self-evaluation

Being the criterion of self-evaluating its own administrative actions by theadministrative system, the administrative self-evaluation legal system can stimulatethe consciousness of self-discipline and self-control so as to realize self-correction andself-enhancement of the administrative subjects. Only if its provisions of basic itemsadvance its implementation objectively and strictly, the evaluation result will reflectthe good and the bad of administrative subjects’ administrative actions truly andeffectively. Consequently，based on foreign experience of administrative evaluationsystem implementation and China’s own practice of administrative management, theadministrative self-evaluation legal system suits to China’s national conditions is putforward in this paper.In our country, the administrative subject concept ofadministration according to law gradually in recent years, the administrativeselfconsciousness also increase gradually, the administrative subject to administrativeactivities of the self-regulation system will be gradually established. At present, somelocal governments in China has initially established a relevant administrativeperformance evaluation system，butexist in the administrative system of internal selfassessment of the legalsystem is not perfect. The effective implementation ofadministrativeactivities and administrative body to give full play to the initiative ofthe self evaluation has direct relation close, this initiative has spontaneousautonomy,so it is necessary to establish relative to administration external evaluation in terms ofadministrative self assessment of the legal system.Therefore, this paper start from the definition of administrative self evaluationrelated concepts, analyzes the connotation of administrative self evaluation andspecific species, part of the national administrative system of self evaluation of thespecific design of the system and procedure arrangement, reasonable reference andeffective use, combined with the development status of China’s current administrativeself evaluation and existing problems, put forward with me the characteristics of theadministrative self assessment of the legal system. Distinctive features have their own conditions of foreign administrative selfevaluation method, in reference to the valuable experience at the same time, we mustin the endogenous development concept under the guidance of, with their socialconditions, cultural characteristics such as the cornerstone to specific constructionsystem of administrative evaluation in our direction and content. Therefore, we shouldfirst clear definition of the subject of administrative self assessment of the legalsystem of choice, because the evaluation of the main selection directly determines theevaluation object, evaluation to determine the specific content, evaluation of theselection; secondly, to deeply study the self assessment of the legal system of specificcontent, including the policy evaluation, performance evaluation, comprehensiveevaluation and individual evaluation, the purpose is to all administrative activities ofadministrative subject are bound to the administrative self assessment of the legalsystem; finally, the procedure and the way of administrative self assessment of thelegal system, unified interpretation of evaluation results of open and application aredetailed specific research. In order to effectively implement the administrativeresponsibility, administrative efficiencyand quality, implement the specific evaluationsystem of administrative self level.
