Research On The Social Appraisal In The Administrative Evaluation

Administration according to law is the difficulty and key to rule the country according to law.It is the inherent requirement of the construction of government ruled by law and the basic path of "basically building up the government by law by 2020".Organization has management and goals."building through evaluation" is in line with the principles of organizational management and motivation,and is an effective means to achieve organizational goals.Since The Eighteenth National Congress of the CPC,based on the "government promoting mode of building the construction of government ruled by law",the administrative evaluation has provided impetus for the construction of government ruled by law.In the evaluation system,the social appraisal has become the basic concern of the academic circle,and it is also a problem in the practice of local governments.In the social appraisal,the democracy and scientificity of public participation and public satisfaction measurement depend on the transparent and open society,the rational expression of the public,and the mature and feasible investigation technology,which is an ideal state.Based on the professional attributes of the administration according to law,the expert comment can make up for the limitations of the public evaluation,and reflect the professional rationality more,and has an irreplaceable role in the social appraisal.Regarding this point,this paper tries to explore the public evaluation and the expert comment's functional boundaries and the relationship between their complementary and mutual evidence in both the value level and the technical level,according to the local practice and empirical experience,so as to provide a scientific basis for the improvement of the system of the social appraisal.This paper involves theoretical methods of disciplines such as law and public administration.Through the methods of normative analysis and empirical analysis,this paper discusses the legal basis,system structure and actual conditions of the public satisfaction measurement and the expert comment in social evaluation of the administrative evaluation.First of all,it studies the democratic rule of law theory,the construction theory,evaluation theory,performance evaluation theory of government ruled by law based on socialism with Chinese characteristics.It is believed that the social appraisal of the administrative evaluation should reflect the result orientation and the guidance of the public satisfaction,and construct the organization system of "the government leading-the third-party implementation-the public satisfaction measurement-the expert comment" Secondly,the research holds that the public satisfaction measurement reflects the democracy and purpose of public participation,but the superficialization and formalization of the public participation weak the democratic value of the evaluation,and form the contradiction between the evaluation's popularity and the professionalism of the administration according to law;the expert comment makes up for the short of the public evaluation,and embodies the professionalism and pertinence,but the technical rationality of the experts depends on the open and transparent social environment,to ensure that the neutrality of the experts can not be separated from the independence of the evaluation subject.Therefore,the social appraisal by the government's internal leading should not only play the function of their complementary mutual evidence,but also introduce the third-party to exercise the right to implement it.Of course,to ensure the scientific,democratic,rule of law and credibility of the evaluation,the independent third-party evaluation(as the evaluation subject)is indispensable.The innovation of this study:The first is to innovate and construct a social appraisal system.Social appraisal is the core issue of administrative evaluation according to law.It ensures that the function of appraisal can not be separated from the relationship between public satisfaction evaluation and expert appraisal.From the perspective of value rationality and instrumental rationality,this research constructs a system of evaluation of public satisfaction evaluation and expert evaluation to form a mutual complementation,base on the integration of theory and empirical analysis makes in-depth analysis.The second is to innovate and evaluate the concept of social evaluation according to law.The administrative evaluation and social appraisal according to law are only means rather than purpose.To realize its value rationality and instrumental rationality,this research innovatively introduces the performance-oriented concept,weakens the instrumentality of the past goal-oriented,and enhances the democratic and legal value of social evaluation.
