Research On Soil Environmental Quality Assess Legal System

Soil are the source of human existence and the basic of human development, and the important part of the ecological environment. At present, the condition of soil pollution is severe in China. Major environmental hazard events caused by soil pollution usually occur. To strengthen the protection of soil environmental condition and make special legislation about preventing soil pollution have become the consensus in the academic. In the case of legislative blank, it accords with the basic law of legislation to make policy to strengthen research on soil pollution control legal system.The legal system of soil environmental quality assessment means that in order to prevent soil pollution, improve soil quality of the environment and protect human health, according to certain principles, standards and methods, we should make investigation, analysis and classification assessment upon urban and rural soil in the basic ecological line, and upon the contaminated sites where the usage of land or the landowner has been changed and then put forward a series of methods and systems to prevent or renovate soil pollution to ensure soil environmental quality and safety. Currently, the scope of our country legislation on soil environmental quality assessment is confined to contaminated sites, and some local legislations on soil environmental quality assessment have strong regional limits. The implementation of legal system of soil environmental quality assessment is facing national and local inadequate legislation, confusing management system, unclear assessment, incomprehensive assessment content, lack of specialized legal responsibility mechanism, and make other problems. The relevant regulations of the United States and other countries for soil environmental quality assessment provide us with advanced experience. Against the problems of the legal system of soil environmental quality assessment in China, we should work from the following aspects. Firstly, in order to improve administrative efficiency, the administrative department of environmental protection should be the unique subject of assessment. Secondly, we should revise the existing soil environmental quality standards and add soil environment quality aspects to be assessed.Then, the evaluation objects can be positioned to urban and rural soil in the basic ecological line and the contaminated sites where the usage or the land use right users changed, and regularly carry out soil assessment. Finally, according to the results of a preliminary assessment of the soil, the soil is divided into different levels, and then we can implement phased and targeted assessment activities, and increase the punishment, and at the same time critically assess the legal obligations of different subjects.
