In the modern world, people’s life has become a great change and e-commerce alsohas become a promising new industry with the widespread use of informationtechnology.As the important form of e-commerce, online shopping is so fast andconvenient that a large number of consumers have been attracted. Online shopping haschanged the traditional concept of consumption and consumption patterns, and make thetraditional consumption structure have a great change that it has become an independenteconomic model-the Network Economy.However, when the network economy bring the benefits to consumers, the instancethat consumers’ legitimate rights are infringed become much more. The complaint ofonline shopping was the first in the top10consumer complaints on CCTV3.15show lastyear.Nowadays, the legal framework of China can’t effectively provide people a onlinebusiness environment which is credible and safe. Thus, in order to avoid consumer rightshave been infringed and lose the confidence of online transactions, which will affectthe healthy functioning of e-commerce. It is necessary to research the protection ofconsumer rights in online shopping.This thesis writes along the idea of "founding problem-analyzing problem-solvingproblem". Researching the realities of online shopping environment by the method ofdata analysis, analyzing the problems of consumer protection in the online shopping andsolutions by the method of combining theory and practice, comparing foreign-relatedlaws and regulations and concluding the experience by using comparative analysismethod.Chapter one is an over view of the concept and features of online shopping, anddefining the consumers of online shopping. It depict the emergence and development ofonline shopping and the difference of e-commerce and online shopping, then definearticle range. Chapter two pointed out the status of the consumers rights’ infringement inonline shopping of our nation, including the right to security, the right to information, theright to fair trade, the right to independent option and the right to damage claims are notguaranteed, and analyzing the reasons.Chapter three analyzes the current situation of thelegislation about protecting consumer rights in domestic and international online shopping, points out the problems of our nation’s legislation, and summarizes thecharacteristics of foreign legislation, which can help us learn some useful experience.The last chapter presents recommendations on consumer rights’ protection in China ’sonline shopping, including the concrete ideas of protecting consumer rights, establishinga unified and effective regulatory mechanism of network market and creating aconvenient and efficient dispute resolution mechanisms. So we can create a healthy andorderly network market, and give consumers’ legitimate rights better protect.
