The Impact Of Network Public Opinion On The Credibility Of The Judiciary

Under the New media Age, the network impacts every corner of our life. Through the network, a way totally different from traditional style, more and more people amplify their voices. In this case, neglects and obvious foul-ups in the handling of the high profile cases will likely cause a great disturbance. The online engagement about the relationship between justice and public opinions show us that, judicial organs aiming to safeguard fairness and justice have been the most talked-about subject and simple suppression of internet public opinion is very inappropriate. Judicial organs have to correctly deal with the relationship between justice and public opinions to promote public reputation construction in a positive and functional way.In this thesis, from the perspective of jurisprudence, firstly to clarify the basic theory of network public opinion and public credibility of the judiciary, including the meaning, characteristics of the network public opinion, law of development and the basic theory of the public credibility of the judiciary, to provide theoretical basis for further research of network public opinion on the public credibility of the judiciary. The second part mainly from the positive and negative effects of network public opinion analysis of the public credibility of the judiciary. On the one hand, the network public opinion promotes the public credibility of the judiciary plays, such as protection, the due process of democratic rights, supervision of the judicial justice and to boycott the judicial corruption; on the other hand, the network public opinion the hindrance role to the public credibility of the judiciary plays, for specific performance of the network public opinion universal ethics the impact of network public opinion tendency of judicial rationality, the non rational color interferes with judicial independence and network public opinion "public trial" shake the authority of the judiciary in three aspects. The third part focuses on the analysis of the causes of the credibility of the network public opinion challenges, and learns from foreign experience, and finally put forward a sound network public opinion to the judicial credibility construction path. So this paper has important research significance.
