Legal Issues Statistical System

Statistics is an important and basic work in the scientific decision and scientificmanagement by the state, plays an important role in the construction of modernization in ourcountry and is inseparable whether for the control over the national conditions and thenational power or the judgment over the social and economic development situations. Sinceits promulgation, the Statistics Law of the People’s Republic of China was revised two timesand at present our country has already initially established a relatively sound legal system forstatistics and the functions of information, consultancy and supervision of the statistics havehad relatively full play. With the rapid development of economy, the government and varioussocial circles have posed continuously higher requirements for the statistics, the conflictsbetween which and the defects in the existing statistics legal system are exposed increasingly.This paper endeavors to proceed with the statistics from the perspective of law tospecifically analyze the current problems and deficiencies in the legal system for the statisticsin China, and propose some suggestion for the legal system therefor on the basis of referringto the foreign legislation and practice experience of the statistics.Apart from the introduction, this paper consists of four chapters:Chapter One discusses the basic theoretical base for the statistics and mainly introducesthe definition, characteristics and functions of the statistics.Chapter Two elaborates the status quo and problems of the legal system for the statisticsin China and the reasons therefor. This chapter proceeds with the analysis of the legislationstatus quo of the legal system for the statistics in China, then analyzes the legal systemtherefor with the various illegal statistics cases as the starting points, proposes the currentproblems in the system for the statistics management, the system for the statisticsinvestigation, the management on the statistics data and announcement system, the system forthe statistics supervision and examination and the system for the legal accountability andanalyzes the reasons therefor.Chapter Three makes reference to the relevant legal systems for the statistics in foreigncountries. This chapter mainly introduces the provisions of other countries on the system forthe statistics management, the system for the statistics investigation, the management on thestatistics data and announcement system, the system for the statistics supervision and examination and the system for the legal accountability so as to provide reference for thefurther revision and improvement of the legal system for the statistics in China.Chapter Four proposes suggestions for the improvement of the legal system for thestatistics in China. The author, referring to the current problems in the legal system for thestatistics in China and combining the own statistics working experience, makes analysis fromthe improvement of the current system for the statistics management and the intensification ofthe statistics independence, the regulation of the statistics investigation, the advancement ofthe reform on the statistics methods, the improvement of the system for the management andannouncement of the statistics data, the intensification of the base-level building of thestatistics, the stability of the statistics team, the accurate definition of the illegal statistics, theintensification of the supervision over law enforcement, the refinement of the legalaccountability for the statistics and the intensification of punishment measures.
