Research On The Legitimate Rights And Interests Of The Juvenile Delinquents

The report of the eighteenth National Congress of the Communist Party of China says:"Protect the legitimate rights and interests of women and children""Help all children gain required knowledge and skills".Please take the ’Juvenile Delinquents Proposal’ to the conference, which is a very hot topic during the2012—2013Two Sessions. Juvenile Delinquents are not born of the wicked. There are many factors cause their behavior deviation.They are not only the victims, but also the endangers. They are the special vulnerable groups. The whole society have the responsibility to safeguard their rights and help them return to the right track of life, avoid them bring greater harm to society and family. This is a realistic subject that the party and the government, society, schools, families and every citizen should concern about juvenile delinquents and protect their legitimate rights and interests.Teenagers are the future of the motherland and the hope of the nation. With the development of society, factors, such as the social environment, family structure, psychological problems, which related to the growth of young have changed. Juvenile delinquents are victims of negative effect of these factors. Taking care of juvenile delinquents, revealing the essence behind the phenomenon, putting forward measures to protect their lawful rights, are not only benefit for the juvenile delinquents but also the thousands of teenagers. Therefore, juvenile delinquents are worth being concerned and their legitimate rights are worth being protected. The study focuses on the problems juvenile delinquents have to face now and future in the legal system, social status, education, family protection, personal factors and many other aspects. This article takes juvenile delinquents’ legitimate rights as the starting point and the foothold, illustrates the basic connotation of the juvenile delinquents’rights and characters. Based on the characters of the juvenile delinquents and the practice of their life, the main contents of juvenile delinquents’ rights has been summed up which involves the right to survival and development, the right to life and health, the personal dignity and the right to happiness. The fragmentation of social roles made survival and development difficult for the juvenile delinquents. Juvenile delinquents are experiencing difficulty finding jobs because of the vulnerability labor skills. The negative effect made juvenile delinquents marginalization and hard to grow up healthily.In the course of the study, the author has collected large amounts of reference. By analyzing and integrating different kinds of data, this paper describes the main existing problems of juvenile delinquents’ right, sums up the cause of those problems which include four aspects:the juvenile justice system is imperfect, the social security system is weak, the home schooling is not in place, juvenile delinquent themselves are not ripe. Based on the reasons above, the article puts forward some countermeasures respectively in legislation and justice, social security, self-improvement and family care. In summary, when we analyze this question and dig out the roots of the phenomenon, it is not difficult to see that juvenile delinquents are victims of infringement of right. They are the epitome of teenagers those who are not understand how to safeguard their rights.Juvenile delinquents’ legitimate right is a typical part of the rights of youth groups in China. They have paid a heavy price for their right. The starting point of this study is the legitimate rights and interests of juvenile delinquents, but it also ultimately reflect the existing issues of youth rights protection in our country. The protection of vulnerable youth groups in legal and society aspect are weak in our country. This study is from the human right perspective to help juvenile delinquents. Comparing with save, education and treatment, the study pays more attention to safeguard their legal rights and interests. Different from judicial negative prevention in the past, this article abandons the conception of crime and punishment, turns to protect young people actively and realizes the final goals that all the young people could be protected perfectly. Of course, due to objective conditions, personal knowledge and capacity, there are also some defects in the study. Maybe the analysis of some question is not comprehensive, precise and profound.
