Summary: First this article intriduces that teachers'employment system in China is based on Teachers Law of People's Republic of China. This system is the requirement of improving the teachers'management system and now is being used according to the requriement of the reform of personal system in the institutions in China.Compared to the old system, teachers'employment system has solved the malpractice of administrative appointment and life empolyment brought up by the old system. This system also helps to realize the change from state teachers'employment system to units teachers'employment system, from fixed teachers'employment system to contract management system and this holds identical views with international way. Teachers'appointment system will surely have a deep effect on the great changes of teachers'professional construction and development. This article sums up the aim of teachers'employment contract management, which is regarded as a contract between schools and teachers. This aim helps both sides to make clear their rights and interests and its nature is teachers'appointment system, which means to employ the citizens who have the requisite qualifications.This article thinks that teachers'employment system reflects people-center idea in management and the usage of this system changes administrative appointment system and enlarges the employment rights of units. Contract management can not only promote teachers'professional vigor and quality but also facilitate teachers'rational flow and distribution. Now we have a very good response of teachers'employment system in our investigation and this system is very effective and makes a strong foundation of teachers'profession construction.This article thinks that teachers'employment system is still young in China, so it is sometimes imperfect related to some laws and policies. There are disputes like teachers'lawful position, employment right etc. There are also some unsatisfied method in the real practice like executing standard, contract time limit, etc. And some wrong methods have caused bad effects on the teachers'working actively and steadily. Employment reform doesn't solve the problem of the teachers'rights protection and there are affairs that infringe teachers'legitimate rights and interests in reality. In some places, the employment is only as a matter of form and doesn't work actually. So teachers'employment system in our country is not deepgoing and systematical.This article mainly discusses the shortcomings and problems in teachers'employment system in our country and puts forwards suggestions and countermeasures in order to improve the system and protect teachers'legitimate rights and interests. First, some law and rules should be made out as soon as possible so that employment will be brought to justice and teachers have lawsuit right. Second, some systems related to teachers'employment should be improved, such as schoolmasters responsibility, teachers check, distribution system and supervising system. Third, employment working procedures should be standardized. Fourth, employment channels should be widened so as to solve the teachers'flow. Fifth, investigation and summary should be paid more attention and also experiences from abroad should be studied carefully so as to strengthen the theory research on teachers'employment system.
