Visible as a basic education policy in ourcountry, promote the education equity is an important content andthe objective requirement of building a socialist harmonious society.The education equity is only based on laws and regulations can betruly realized, that is to say, to guarantee school-age children’s rightto education has an irreplaceable role in the process of realizingeducation equity."Right to education" embodied in the threeaspects:"right to the opportunity of education"," right ofeducation condition ","right to get the education ". In these three kinds of rights, right to the opportunity of education is the startingpoint and key, it plays a decisive role on the whole implementationcondition of the right to education.This study through the questionnaire and interview two kinds ofmethods,the school-age children and parents of10cities,20counties,121primary and middle schools in Shanxi Province assample,to investigat and analysis the status of Shanxi school-agechildren’s rights to opportunities of education, the survey showedthat more than ninety percent pupil can go to nearby school, morethan seventy percent pupil can go to school on time, sixty percentpupil can be an exemption entrance, nearly ninety percent of juniorschool students can go to the nearby school and nearly fifty percenthave an exemption entrance, the students of choosing school s ashigh as a quarter of all the students. Choice method ofschool-choosing is given priority to with score choice. To found fiveproblems: the distance is far, delayed admission,serious fees, anexemption entrance incomplete, school choice cost become theburden of family. Through the problems, found five reasons:withdrawal school speed too fast, lack of a scientific andreasonable planning; Entrance system lacks flexibility, parents ideabehind; Education funds investment is insufficient, lack ofreasonable and effective supervision mechanism; Remaining keyschool advantage, binary pattern limits educationof migrant workers’ children; enforcing student go to nearbyschool, right protection of school-choosing is still blank.Toguarantee school-age children’s rignt to opportunity of education,this artical put forward the countermeasures from the following aspects: set up schools according local conditions, change the wayto decisions; Education department should be flexible to cope withthe actual situation, to improve parents education idea; Increaseinvestment in education funding, strengthen the supervision; Tobreak the binary pattern, narrow the gap between school; Step bystep to establish legal policy of right to school-choosing, safeguardthe rights and interests of students. |
