When the system of commercial housing in advance shows its advantages,it also has theinherent risk.,especially for the buyer. The most serious is the developers run away with thepre-sale funds, leading to the buyers without house and finance. Getting to the root of thephenomenon, mainly because the use of the commercial housing presale capital has not beengiven sufficient attention. Because many developers abuse the presale capital of commercialhousing, the projects in construction have to shutdown, What is worse, the projects becomeuncompleted residential flats. To reduce the inherent risk of the system of commercial housingin advance and avoid the occurrence of serious social problems, On one hand, the majority ofprovinces and cities choose different regulation bodys of the presale capital of commercialhousing and the corresponding program. On the other hand, academic circles have also beenactively discuss to attempt to determine a reasonable regulatory body.According to the present research status, academic research is mainly based on thesupervision of the main criteria for selection, compared with the supervisory system of specialresearch. This article try to carry out comprehensive analysis in the regulation theory, thecurrent legislation situation and its causes,other countries and regions of the advancedexperience of the supervision and China ’s regulatory processes involved in the currentsituation of main body and function. Through this comprehensive analysis, this article couldconduct deep discussion on regulation bodys of the presale capital of commercial housing, regulation period, the scope of supervision, the use and management of the presale capital ofcommercial housing and legal liability.In order to ensure the sale of funds use safety,Not only to improve the financialregulatory system, there should also be a series of measures to support the sale of fundssupervision system to carry out. So, this article constructs the information platform of theregulation of commercial housing presale capital and the risk early warning mechanism ofregulation of commercial housing presale capital. The information platform could realize theinformation feedback, supervise and other functions; the risk early warning mechanism couldpromote the sale of capital supervision mode to establish more effective operation.
