The research of China’s wind energy industry is considerably far behind those developed countries, such as U.S. and European countries. However, the Chinese government provides a series of wind energy-friendly policies that strongly support China’s wind energy enterprises to achieve a spurt of development in past decades. Behind this positive appearance hide some serious problems, which domestic wind energy enterprises will have no chance to root into the global wind energy market without resolving them. Lack of essential technology is fatal, and Chinese enterprises have been stuck in the dilemma after the government partly decreased the positive policies.The purpose of this study is to provide advices for patent strategy of China’s wind energy industry based on the realistic condition of domestic wind energy companies. From the technology innovation system; wind energy industry’s operation and technical patents analyzing of main energy consumers and wind energy research pioneers, U.S. and Europe, were compared. Through the collection, retrieve, analyzation of patents about wind energy and classification of the patents by Bradford’s law, we could have the IPC of core patent for wind energy technology. Then by analysing the core IPC and applicating the Lotka’s law could we identify the core patentee, which were calculated by CHI patent indicators to obtain the patent indexes. Combined with indexes from CHI analysis, SWOT model of analysed wind energy enterprises was built to analyse the strength, weakness, opportunity and threat. Through the collection and organization, the new energy policies in countries and regions were compared to conclude that, a development of new energy policy has a profound impact on the development of the wind energy industry. In the formulation of the patent strategy government should combined with the companies and play the role of guidance and supervision. Chinese wind energy enterprises are lack of core patents, R&D investment and so on. We should increase the investment in research and avoid being over dependent on the patent strategy of collaborative R&D. We should make efforts to achieve a cross licensing by surrounding the core patents with peripheral patents, and maintain the costumers with high qualified after-sales service.
