Moderate residential rights in essence is a public management problem, because itrelates to the majority of public interests, therefore in the study must be applied to thetheory of public management. From the relationship between speaking, moderateresidential rights needed to achieve through the real estate policy, can be said that thepolicy itself is moderate residential rights protection measures. While moderate housingrights is an important objective of real estate policy implementation, and of course realestate policy objective is rigid surface, moderate residential rights protection is just one ofthem, the relationship between them is two. In order to promote the healthy developmentof real estate, to curb rising prices too, the country introduced a number of listed realestate policy, to meet the people’s demand for housing. These policies include low-incomehousing construction, the purchase policy, the new "five countries", the supply structure ofreal estate management etc.. These policies to stabilize prices, to ensure the healthydevelopment of the real estate market, the good effect of the people’s housing needs met,the existing real estate policy can meet the people’s housing needs at a certain extent, butthere is a significant distance from the appropriate security housing rights, especially someunsatisfactory effect of policy implementation, and even appeared in the transfer priceshigher phenomenon, realize the serious influence to the right to housing. This sectionmainly with the content of these policies, analyzing the deficiencies of existing policies inthe moderate right protection, and analyzes the main reasons of these problems. In thispaper, according to the current research data, combined with the State Council’s moderatehabitation right spirit, on how to improve the shortcomings of existing policies, in order toachieve the appropriate residence protection purposes, puts forward specificcountermeasures and suggestions, with a view to provide some help and Enlightenment tothe policy makers and implementers.
