Under the background of promoting the integration of urban and rural areas and destroying the structure of urban-rural dual, How to innovation and breakthrough system, to build rural collective land circulation system, to improve the efficiency of agricultural land for the voluntary, to eliminate unreasonable waste of idle land transfer and land, to protect the collective interests of the vast rural areas and farmers’ personal interests, promote the construction of new socialist countryside, those that of aspects are of significance.During our current economic development, collective land transfer is particularly valued. Due to the legal system, the transfer method, transfer procedures are still not perfect. Driven by the interests, Collective illegal land expropriation and recessive circulation, therefore, there are a lot of illegal transfer of land disputes increasingly has become one of the factors of social instability. Under the existing legal framework, members have a few rights of rural collective land and unclear land ownership. Land users can not self-transfer, transfer, lease or mortgage, which affecting the collective land circulation market development and improvement. The existence of these contradictions and problems has made that collective land circulation system reform become the difficulty and focus of China’s land system. Therefore, improving the land transfer system, regulating the circulation mode, allocating the transfer income reasonable, promoting rural economic development and social stability, which make the current collective land circulation, become an urgent problem need to be solved.Theoretical basis of this thesis, researching from the land transfer background and land transfer to start, which proposed why raise collective land circulation, what is the premise and basis of circulation, thus answering the principle of equality of property rights, land development theory and necessity. To explore from clear land property rights system, to improve the social security and unified land market three levels, promoting rural land also need appropriate institutional infrastructure. Clear land ownership is to regulate collective land ownership, strengthening collective land use rights, improve social security and land transfer behavior norms, establish a unified, open and orderly market system of urban and rural construction.The author studies the land transfer of foreign advanced countries, compared to land the UK, France, USA, Japan, the circulation of the historical development of these countries, which proposed the inspiration and reference of land transfer to China. Thereby when introducing Chinese land transfer process, the thesis proposed the pros and cons for the role of government, and then proposing the corresponding theoretical construction and new ideas.
