The Anomie Research About Transfer Of Right To Use Collective Land In Shanxi Province

The countryside land system is the foundation and core of the rural economic system. Whether the arrangement of system is successful or not, not only relates to the reasonable exploit of the countryside land and the overall development of the rural economy, but also plays a crucial role in the economic development of the whole social.The present farmland system of household undertaking, as the product of the reform and open policy, forms after the countryside collectivization and the people's communalization. In these years, it not only has successfully solved the problem of food and clothing for 1.4 billion, effectively improved people's life and expense quality, but also made a historical contribution for China's rural economy and even the growth of the entire national economy. However, it is impossible for the system of household undertaking to solve all the problems during the process of agricultural development. With the acceleration of industrialization and the high growth of the entire national economy, many problems are exposed under the system, mainly including:First, the limit of land rights is unclear, the subject is indefinite and the relation is chaotic;Second, the farmland management disperses so it is difficult to form the economic scale; Third, the land transfer is too difficult to adapt to the development of market economy.Shanxi Province, as the birthplace of the Chinese nation,was once a very beautiful natural place, but in late Yuan Dynasty to the early Ming Dynasty, the natural environment in Shanxi became very poor with barren soil,cold weather, rare biology and no dependents, which formed the contradiction between the population,land and resources.Since the policy of reform and open was carried out, large-scale and frequentand spontaneous land circulation has taken place in the counryside in Shanxi with the development of the society and economic.However, there are a great many problems of the irregular land transfer, which hinders the improvement of economic development in those rural and causes a lot of social problems. Therefore, how to regulate farmland transfer becomes an important realistic problem.This thesis makes a systematic study for the connotation of agricultural land transfer, classification, basic theory, influencing factors.and the existed problems.That is, agricultural land transfer will divide into internal transfer and external transfer according to whether agricultural land use will change or not. Moreover, the thesis states their form,connotation and the theoretical background in detail.Based on the basic structure, the thesis employs the typical case to analyze these problems, for example,the imperfect law and regulations that existed in agricultural land transfer, collective land market imperfections, the low land transfer prices, the land ownership of farmers violated;create a pattern that adapt to the transfer of agricultural land in Shanxi.In order to solve the above problems, we should improve laws for the circulation of right to use collective land and make clear the range of circulation, establish relative price system, reasonably set the proportion of circulation profit, promote the establishment of property right market of collective land and then improve farmers'scientific and cultural quality and cultivate new farmers.
