The exclusive agent, which arises in the process of the development of the agency system, is an agency mode that can eliminate the vicious competition triggered by the multiple agent for the reason that principals, under the condition of this mode, only need to contact with a single agent instead of dealing with several agents, so that the transaction can be simplified as well. Therefore, the real estate brokerage exclusive agent system can improve the transaction efficiency, balance the rights and obligations between the principals and agents and promote the sound development of the real estate market. However, at present stage, specialized and detailed regulations should be brought into the system, and the problems arose from the justice practice should be solved.The whole paper is divided into four chapters:Chapter one introduces the theoretical basis and realistic significance of the real estate brokerage exclusive agent system. Firstly, introduce the definitions and concepts of the agent, the exclusive agent and the real estate brokerage exclusive agent system. Secondly, analyze the theoretical basis of the system from the perspectives of the economics, management and legal science respectively. At last, point out the realistic significance of this system.Chapter two analyzes the contents of the real estate brokerage exclusive agents system, including the nature, composed elements, acquisition and characters of the attorneyship and constitution of the legal relationship. Then point out that as a subcategory of the real estate brokerage agent system, on account of the exclusive attorneyship, the exclusive agent differs from the general agent from the perspectives of behavior rules, rights and obligations between principals and agents and the legal consequences of the agent affairs.Chapter three analyzes the legislation and practice situation of the real estate brokerage agent system, and points out that the main reason of the practice dilemma of the real estate brokerage exclusive agents system is the insufficient of theoretical knowledge of the system, rather than the defect of the system itself. To solve this problem, it is necessary to perfect the regulations to precipitate the actual effect of the system.Chapter four from three aspects puts forward advice to improve the real estate brokerage exclusive agent system, that is, the aspects of diminishing the cognitive obstacles of improvement of this system and perfecting the system itself and the relative supporting system.
