The world today is becoming an era with the features of creation, adjustment, and innovation. Competitions between countries are mainly determined by many sophisticated factors such as national strength, scientific and technological innovation and intellectual property competition. Knowledge is increasingly becoming the first resource element of the economic growth and social development, thus, the system which helps to promote knowledge production and transformations, that is, a well developed intellectual property protection system, is to determine the national competitiveness. This paper focuses on the process of historical change in the level of IPR protection in China and also considered the various factors which might affect the level of IPR protection in ChinaFrom the early 80s of last century, the intellectual property protection system was established. China's IPR protection has made remarkable progress. At present, China has basically reached the legal protection of intellectual property rights TRIPS Agreement standard, but due to intellectual property protection "law enforcement effect" is relatively poor, leading to the actual intellectual property protection in China is still at a relatively low level. In this paper, based on the actual situation in China, we built the index system to measure China's level of IPR protection and make related evaluation. We found that weak social legalization, judicial administrative protection of intellectual property protection, weak public awareness of intellectual property protection and late membership of the WTO are the main reasons for the poor "enforcement effect" of intellectual property protection in ChinaBased on all sorts of literature, we found that the level of IPR protection in China is affected by the scientific and technological development, foreign trade, patent applications, and many other factors. Using China's 1985-2007 data as the basis for quantitative analysis, we found that the level of IPR protection in China and China's economic development has a close relationship. Moreover, with the continuous improvement of the level of innovation, we should increase intellectual property protection enforcement so as to increase the actual level of IPR protection.Most recent Intellectual property protection literature argued that the high level of IPR protection is due to the economic growth, foreign investment, innovation promotion. Very few scholars would consider what might in turn affect the protection of intellectual property level. This paper started with a macro perspective, discusses the impact of intellectual property protection in China and conducted sufficient qualitative analysis at the same time. With more attention to empirical research, this paper would help us to have a clear understanding about what affect the actual level of IPR protection in China.
