The Research Of Forest Disaster Prevention Legal System Under The Climate Change Perspective

Climate change has become a huge environmental problems in the whole world. At present, with the rapid development of Chinese economy and significantly improval people’s living standards, forestry construction faces increasingly difficult task, not only have to bear the rapidly growing economy which demand for forest products, but also bear great historical mission of mitigating climate change, improving ecological environment, and maintain national ecological security. As one of the most important forest ecological system of land, it is the most basic material guarantee of sustainable forestry development in China, and the fundamental natural resource and the strategic economical resources of development of human society indispensable. However, in the vast complex geomorphic conditions and long growing period, as its own particularity,the forest ecosystem is very vulnerable to the invasion of various disasters and accidents. Especially with the climate change trend basically determined, climate events frequent extreme, further increase forest disaster possibility and the vulnerability of the forest ecosystem, forest disaster prevention and control situation is very grim. Therefore, to strengthen the effective control of forest disaster, protection and development of forest sustainable health, promote the efficient use of forest carbon sink, guarantee the supply of forest products sustainable and improve the ecological environment of human society, is an important content in response to global climate change process in our country.Therefore, based on the background of the global climate change, a careful analysis of the major impacts of climate change on forest disaster.on the basis of domestic and foreign research results and successful experience,I have in-depth studied forest resources of our country response to climate change from a legal perspective, and form three aspects of the prevent disaster, disaster emergency and disaster protection legal system control of main forest disaster related to improve, aims to promote the constructing and improving the system of our country forest disaster prevention law, provide a powerful guarantee for the sustainable development of forest ecosystem and forestry economy.This article is divided into six parts. First of all, this article from the research background, significance and purpose of this paper, summarized the article introduced the basic contents, research route and related legal system of forest disaster prevention research status at home and abroad. Secondly, the article introduces the basic concepts related to climate change and forest disaster, and from the perspective of the dialectical relationship between climate change and forest disaster, negative feedback of sustainable development of national forestry further analysis of climate change have a significant impact to the forest disasters and forest disaster under the new background; Third, the article introduces the four basic theories related to prevention and control of forest disasters, for the purpose of this study-the legal system of forest disaster prevention to provide certain theoretical basis; Fourth, analyze and summarize to the forest disaster prevention law of the foreign system, to China’s response to climate change under the situation of forest disaster prevention law construction plays a certain inspiration and reference; Fifth,with trends in climate change, pointed out the defects and shortcomings of forest disaster prevention law system in China in the process of addressing climate change; Finally, throughout the entire forest disaster prevention system, by combining relevant theories and successful experience for the prevention of disasters in foreign forest reference, the article separately from three angles of the pre-disaster prevention, disaster emergency and disaster protection, mainly aimed at the system of forest fire prevention and the system of forest diseases and insect pests, emergency preventions include forest fire emergency plan system and forestry harmful biological emergency management safeguard of provide for the legal system,and remedy types contain the system of forest insurance and forestry fund system are analyzed and improved, in order to promote forest disaster prevention management ability in China under the background of climate change.
