The Research Of Music Copyright System And Construction

With the progress and development of China’s music market, music copyright issues have become the focus of the music industry. But there are still some problems that leads authors’ interests can’t be protected, and seriously affects the source and restricts the development and virtuous circle of the music industry. This paper analyzes the environment of music copyrights, finding its problems and proposing solutions.This paper mainly used methods of literature researching, case analysis and interviews. It’s divided into four parts: Firstly, reviewing the cultural environment of music copyright system, it included the history and adscription of music copyright, and searching the consequences under the missing copyright system; Secondly, analyzing comparatively the incomes and growth trends of music copyright, and find the economic value with nearly big events; Thirdly, analyzing comparatively the quantities and incomes in mainland China and Taiwan of China, and researching the dispute cases of music copyright; Fourthly, giving management mode of music copyright, and proposing appropriate solutions to the problems.This paper contains lots of informations and dispute cases from Huayi Brothers Music Company, Intellectual Property Tribunal of Chaoyang District and the professor in Law School in Peking University. It proposes the problems of Law, Copyright Collective Management Organizations, Musicians, and giving advices to the music copyright system. It’s good for perfection of music copyright system, and useful for the musical workers with practical guidance and reference.
