A Report On The Application Of Skopos Theory To C-E Tranlation Of Jiujiang Fishery Administration Penalty Discretion

Legal language is a professional and instrumental language, so legal translation possesses the characteristics of using formal words, general terms, repeating structure and standard format. Legal translation has played an important role in resolving disputes and protecting governance in different civilizations for a long time. Along with the deepening of research on translation, the legal translation has advanced from literal translation of word-to-word and sentence-to-sentence translation to strict and systemic translation by the application of different translation theories. Skopos Theory, the core theory of functional school, defines that translating is a kind of motivated human activity, and the translating process is decided by the purpose of translation and guided by Skopos Theory. The emergence of Skopos Theory provides a top-down theoretical framework in studying the function of the legal text and the force of law.This report is based on a program of translating practice. The source text excerpted from chapter 1 of Jiujiang Fishery Administrative Penalty Discretion is a penalty specification of fishing law. Reviewing the research achievements of this realm, the author applies the Skopos rule, coherence rule and fidelity rule to legal translation, and demonstrates major legal translation strategies in the specific translation materials. Based on the above study, this paper concludes that Skopos Theory can be an effective guidance to translators for choosing translation strategies and improving the quality of legal translation.
