The Chinese educational law makes a clear regulation, that each age-appropriate child has the equal right to education. However, in practice, in terms of special education right guarantee, scholars are much more concern about the children who are physically disabled, and not paying much attention to the children who have special needs to education, such as gifted and talented children. Theoretically, gifted and talented children, as a part of normal children, have right to receive equal and adequate education as other children for their ultimate development. In this dissertation, gifted and talented children are regarded as study objects, and it makes an intensive research on the guarantee of their educational right. The ultimate goal of this dissertation is, through taking an active interest in growth and development of gifted and talented children, and not let them becoming a part of problem children or disadvantaged group in children education.Case study, interview method and documentation method are mainly used in this dissertation for knowing the current situation of gifted and talented children education, and with the analyzing of existed documents reveal the problems of current gifted and talented children education, and then analyze the cause of the problems from teachers, parents and children themselves. The study finds that, gifted and talented children can not receive adequate education for developing their potentiality and ability if only depends on current school education system. Furthermore, while educating gifted and talented children in school, teachers, parents and children themselves are under great pressure, especially teachers and parents are really confused about that. This dissertation suggests that, the great pressure of the examination to higher level school, the individual education idea are not translates into concrete practices in the period of basic education, and the lack of individual educational policies are tops three reasons for the problems of gifted and talented children education.For all the reasons above, this dissertation attempts three thoughts about the problem of gifted and talented children education:firstly, from the subject of gifted and talented children education, parents need to undertake more responsibility than school for educating their children, secondly, in order to improve the potentiality and ability of the children, individual education idea needs to translate into concrete practices, thirdly, the educational policy needs to lead and give the protection of individual education right to children who are gifted and talented in certain area.
